Leaving the Scene of an Accident “HIT AND RUN”
The New Jersey statute that governs “Leaving the Scene of an Accident” is N.J.S.A. 39:4-129. You could be given this ticket if you are in a serious accident and flee the scene, or if you get into a small “fender bender” in a parking lot and drive away, even if you leave your information on the other owner’s car. If you get into an accident in New Jersey you must immediately stop your car or at the next safest location and exchange information with the other driver.
The penalties for violating the statute are severe. However, these penalties also vary depending on the circumstances of the accident and the extent of injuries and property damage. If the accident caused a death or serious bodily injury, you could face:
up to 6 months in the county jail;
a one year driver's license suspension;
8 motor vehicle points on your license; and
fines up to $5,000.
If the accident caused only damage to someone’s car or property, you are facing:
up to 30 days in jail;
6 month driver's license suspension;
2 motor vehicle points; and
fines up to $400.
